Electronic Check Notification |

Authorization to Convert Your Check For any check you send, deliver, or provide over the phone or online to Skyway Networks for payment of services or products, your check will be converted to an electronic check payment, as provided by the federal Check Clearing for the 21st Century Act (aka the "Check 21 Act"). Your converted check will be electronically transmitted to your financial institution for payment to Skyway Networks. By sending or delivering your completed signed check to Skyway Networks, or by providing your check account information by phone or online to Skyway Networks, you authorize Skyway Networks to copy your check and to use the account information from your check to make an electronic fund transfer from your account for the same amount as provided on the check. If the electronic fund transfer cannot be processed for technical reasons, you authorize us to process the original paper copy of your check. Insufficient Funds The electronic fund transfer from your account will usually occur within 24 hours of Skyway Networks' receipt of your check, which is faster than a paper check is normally processed. Therefore, please make sure that you have sufficient funds available in your account when you send us your check. If the electronic fund transfer for your converted check cannot be completed due to insufficient funds in your account, you will be required to submit the returned check fee and/or an alternative form of payment as described in the Skyway Networks Master Service Agreement. The returned check fee may be collected from your account as an electronic check. If your check is returned, and if you advise us to, at Skyway Networks' sole discretion, Skyway Networks may make more than one attempt to perform an electronic fund transfer from your account for the original amount of your converted paper check, in addition to any applicable returned check fees that may apply, as provided by the Master Service Agreement. Transaction Information From Your Financial Institution The electronic fund transfer for your converted paper check will be on the account statement you receive from your financial institution. However, the electronic fund transfer may appear on your statement in a different location than where your paper checks normally appear. For example, the electronic fund transfer may appear under sections titled "Other Withdrawals" or "Other Transactions". You will not receive your original paper check back from your financial institution, as sent or delivered to Skyway Networks for payment. For security purposes and in the event of technical difficulty, Skyway Networks will retain your original check for the minimum period required by Skyway Networks' financial institution. When the electronic fund transfer has been verified by Skyway Networks as completed, your original check will be securely destroyed. Your Rights If you believe you have found an unauthorized or otherwise incorrect electronic fund transfer transaction on your account, you should contact your financial institution immediately. Consumers have protections under the federal Electronic Fund Transfer Act for unauthorized or incorrect electronic fund transfers.
